End of Year 2008

Another year coming to an end since the start of the enbloc saga. We still have to wait for 2nd Feb to come. Many residents felt so let down, they no longer want to wait for any result. These includes those financially not stable. They felt it is best to move than to be caught being seen as waiting for the minority to win. There are also those who prefer not to be seen in Minton.

No one can complain about the upkeep of this place as there are too many houses rented out. These very irresponsible tenants have no feelings for Minton. They come and go. The turnover is appalling.

Difference between High Court and Court of Appeal

High Court - open to public

As we all know, the order for the enbloc sale was passed by STB. High Court is for the loosing party to appeal against that order.

Court of Appeal - open to public

This is the last stage anyone can seek further redress. The judges can also throw the case back to STB whereby whoever lost there were not given a fair arbitration hearing in the first place.

The dropping off does not indicate there is no bad faith. The plaintiffs' representing lawyers can bring up issues relating to point of law only.

What is bad faith exactly ???

AGM 11th Oct 2008

Mmmm, very interesting meeting with people voicing out their concerns. I cannot tell if they were for or against enbloc. But at least there were people who bothered. I went with the feeling it was going to be boring. They just had to go with the formalities of the motion.

I found some of the residents seated at the back rather annoying. Was it due to an agent present or was it the sale committee member or was it simply the number of majority together!

I salute the current team as it is very courageous of them to continue to volunteer even with such uncertain outcome from the High Court verdict.
I am particularly surprised the chairman retained his service though not sure if he would stay as the chairman for another term.

High Court Hearing

October 28 . 2008.

No one knows for sure how many days the hearing will take. The verdict will also take a couple of months to come out.

So who exactly are the present residents of Minton Rise??? The Chinese??? The Indians??? Or the Philipinos??? Are there many genuine residents left???

I just heard our new Mr Chairman also moved.

High Court

The objectors to the enbloc sale filed for an appeal before the date line ends. They felt the order by the STB was wrongly given. The facts this time round are no different from that submitted earlier. However, the fees may be more hefty this level.

STB level

Yes, unfortunately, the objectors who filed against the enbloc sale lost.

Nonetheless, the next level, which is the High Court is where they will again file their objection.

The so called minority has 21 days.

Do not be alarmed by the September timeline as the lawyers representing the majority has 3 months to completion time. After which, there is still another six months . But this timeline will be adjusted further once the minority takes a step higher.

Like I said before, news of more than 1200 units replacing the current 342 units is a very frustrating fact.
